- First Offense OUI: For any first offense OUI conviction, you may face up to 2 1/2 years in jail, a fine between $500 and $5000 and a one-year suspension of your driver's license.
- Second offense OUI: If you are convicted of a second OUI, you could face 30 days of mandatory jail up to a maximum of 2 1/2 years. There is also the possibility of up to $10,000 in fines and the loss of your driving privileges for up to two years.

Third offense OUI: There are mandatory minimum sentences required for third offense (or other) OUI convictions. This means that, even if there are other factors involved, judges have no discretion when it comes to sentencing. For these reasons, it is critical to take these cases to trial and to win.
If you have not had an OUI in 10 years, under Massachusetts law, you can treat a second OUI as first offense under some circumstances. However, you only get one chance for this and it is best to discuss your options with your lawyer.
